Appearance in connection with a request that the Board waive the $900 campaign finance late fee assessed against George C. Metoyer, Jr., a candidate for District Judge, 9th JDC, Rapides Parish in the November 4, 2014 Election, whose 30-P campaign finance disclosure report was filed 15 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, George C. Metoyer states that he did not knowingly fail to timely file the 30-P campaign finance report because he did not receive any notice that such report needed to be filed like he has received in the past. Historically, he states he would receive documentation via mail when any reports were due. Once he received the Notice of Delinquency, he immediately filed his 30-P campaign finance disclosure report.

He states that in 23 years he has never failed to disclose any significant information to the public or this board by failing to file any reports. He further states that he did not fail to disclose any significant information this election cycle because he did not have any campaign contributions or expenditures. He states that since this penalty is penal in nature, adequate notice should have been given to him before the deadline and the only mention of the deadline was in the packet he received when he qualified.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
