Advisory opinion request by Destiny Rohmfeld regarding whether he may accept employment with a future Department of Health and Hospitals contractor as a compliance lead after his temporary position as a program manager has concluded.
Facts:
Mr. Rohmfeld is a program manager for the Medicaid Managed Care section of DHH. He tracks and monitors health plan compliance with contractual requirements. He alerts management of any noncompliance issues that arise and take appropriate corrective actions. He responds to all provider claims inquiries. He reviews, analyzes and evaluates management and system reports designed to provide information regarding health plans contract compliance with program regulations, contractual obligations and cost effectiveness. He acts on behalf of Medical Vendor Administration by attending meetings with health plans, providers, Molina and other stakeholders regarding matters pertaining to Medicaid Managed Care. Finally, he was on the RFP review team that scored the future contractor for DHH.
Law:
La. R.S. 42:1121B(1) of the Code provides that no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
