RE:
Advisory opinion request from Meca Irving, a retired employee of the Department of Health and Hospitals-Retail Food Division, as to whether she may work privately as an approved provider teaching food management classes to private clients.
Facts:
Meca Irving recently retired from the Department of Health and Hospitals-Retail Food Division ("DHH") as a program manager for the Food Safety Certification program. Her former duties with DHH included approving applications for food management trainers to be placed in the Louisiana database of approved providers and teaching Sanitarians employed with DHH food management courses as part of their training. Ms. Irving was not a departmental head while employed as a program manager for the Food Safety Certification Program.
DHH is the agency that issues Food Safety Certificates to applicants that pass the required exam. Ms. Irving would now like to be recognized as an approved provider by DHH so that she may teach nationally recognized training course material and administer the required exam to clients for a fee.

Law:
Section 1121B of the Ethics Code prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction involving the agency of the former public employee, in which the public employee participated at any time during his public employment.
Additionally, Section 1121B prohibits a former public employee, for a period of two years following the termination of his public employment, from rendering the same service which he rendered during his public employment on a contractual basis to, for, or on behalf of his former agency.

Recommendations:
Adopt the proposed advisory opinion.
