RE:
Advisory opinion request regarding whether David Summersgill may be employed as the 4th Judicial District Public Defender assigned to the Monroe City Court (City Public Defender), located in Ouachita Parish, while his mother, Nanci Summersgill, serves as the Monroe City Attorney.
Facts:
The criminal division within the Monroe City Attorney's Office is responsible for prosecuting criminal offenses in the Monroe City Court. The judges of the Monroe City Court, created pursuant to La. R.S. 13:1952, are elected officials. Meanwhile, the City Public Defender, under the authority and control of the Louisiana Public Defender Board, is responsible for defending indigents in criminal proceedings.

Nanci Summersgill will not personally handle or be involved in any way with any case that her son, David Summersgill, may be involved in as a part of his employment.

Law:
La. R.S. 42:1113A prohibits a public servant, their immediate family member, or legal entity in which they have a controlling interest from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed advisory opinion.
