RE:
Request that the board waive the $600 campaign finance late fee assessed against Redell Comeaux Miller, a candidate for School Board, Lafayette Parish in the November 4, 2014 election, whose 10-P report was filed 14 days late. Untimely request to waive the $440 campaign finance late fee assessed for Ms. Miller's 30-P report that was filed 11 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the reports, Redell Comeaux Miller states that she is a first time grass roots candidate who misunderstood the form directions to mean that if cash donations were under $200, and campaign expenditures were under $2,500 there was no need to file reports. She mistakenly thought all contributions of $200 or less could be anonymous. When she realized her mistake, she had to get the addresses of the people who made contributions. She did not think that she would make it the $2,500 mark, so she did not file the 30-P report. She realized later that she would exceed that amount and filed the required reports.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Decline to consider the waiver for the 30-P report.

Suspend all but $100 for the 10-P report based on future compliance. The fine is payable within 30 days or the suspended portion becomes due and owing.
