RE:
Advisory opinion request from West Feliciana Councilman Mel Percy regarding whether the Ethics Code would prohibit the appointment of Robin Hurst to the Fire Board for West Feliciana.
Facts:
Mr. Robin Hurst previously served as the full time Fire Chief of East Baton Rouge Parish and as the volunteer Fire Chief of Brownsfield. Councilman Percy believes this makes Mr. Hurst a uniquely well qualified candidate for the Fire Board of West Feliciana. Mr. Hurst is currently employed with Ferrara Fire Apparatus as a manager over the warranty and Customer Satisfaction Department.

Councilman Percy provided that while the West Feliciana Fire Department has purchased fire trucks from Ferrara in the past, there are no guarantees that they will purchase anything from Ferrara in the future. Fire trucks are currently being purchased through State contract. The Fire Board of West Feliciana does not dictate who is on the State contract list. Additionally, Mr. Hurst's salary is fixed and he does not receive a commission. Further, Mr. Percy provided that Mr. Hurst is retiring next August and barring something unexpected there are no plans to purchase a new fire truck before that time.

Law:
La. R.S. 1111C(2)(d) No public servant and no legal entity in which the public servant exercises control or owns an interest in excess of twenty five percent, shall receive anything of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are neither preformed nor compensated by any person from whom such public servant would be prohibited by R.S. 42:1115(A)(1) or (B) from receiving a gift.

La. R.S. 42:1115A.(1) No public employee shall solicit or accept, directly or indirectly, any thing of economic value as a gift or gratuity form any person or from any officer, director, agent, or employee of such person, if such public employees knows that such person has or is seeking to obtain a business or financial relationship with the public servants agency.

Recommendations:
Adopt the proposed advisory opinion.
