RE:
Request that the Board waive the $540 campaign finance late fee assessed against Michael Barbee, a candidate for City Marshal, City Court, City of Plaquemine, in the November 4, 2014 Election, whose 30-P campaign finance disclosure report was filed 9 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the reports, Michael Barbee states that the certified letter sent by the ethics board was sent to this former address which has not been his address for two years and is not the address with which he qualified for the election at issue. The home at the address the BOE mailed to is for sale, therefore mail is only checked there periodically; he only found out the letter was there after seeing the postmaster at lunch one day who informed him he had a certified letter waiting for him.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Suspend all but $200 based on future compliance with the CFDA. The suspension is conditioned upon full payment of the amount within 30 days.
