RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against Rudy Gorrell, a candidate for Judge, Criminal District Court, Section D, Parish of New Orleans in the November 4, 2014 Election, whose 30-P campaign finance disclosure report was filed 16 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the reports, Rudy Gorrell asserts that he tried to contact Mr. Slava in the BOE office, was not able to reach him so instead faxed and mailed the document on September 24, 2014. He contacted the BOE office again after receiving the delinquency letter, was able to speak with Mr. Slava, and was told that he had received incorrect log-in information. He requests a waiver because he would have timely online filed were it not for the incorrect log-in information.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.


Rule 1205D provides that a late fee shall be rescinded if the candidate withdrew with the Secretary of State from the election and received no contributions or loans and/or made any expenditures, excluding his qualifying fee.

Recommendations:
Rescind the late fee pursuant to Rule 1205D.
