Request that the Board waive the $600 and $420 campaign finance late fees assessed against Edward Butler, a candidate for City Marshal, City Court, City of Alexandria, Rapides Parish in the November 4, 2014 Election, whose 30-P campaign finance disclosure report was filed 10 days late, and 10-P campaign finance disclosure report was filed 7 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the reports, Dennis Sapp, campaign manager states that the campaign officials did not realize campaign reports were required to be filed on the Leaders website. The 30-P report was mailed the day before the deadline via certified mail and the campaign was waiting to receive notification of delivery and had no idea they were incurring fines. He also stated that the 10-P report was created and saved before the due date, but the submit button was not pressed.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Decline to waive the fine associated with the 30-P. Suspend all but $200 of the fine associated with the 10-P, based on future compliance with the CFDA. The suspension is conditioned on payment within 30 days.
