Advisory opinion request regarding the appointment of Celeste Falconer to the governing board of the Florida Parishes Human Services Authority.
Facts:
Celeste Falconer was recently appointed to the governing board of the Florida Parishes Human Services Authority ("FPHSA"). FPHSA was created through legislation as a local governance entity with the responsibility to manage the delivery of services for addictive disorders, developmental disabilities, and mental health in a five parish region.

Celeste Falconer is currently serving as an uncompensated board member and the Chair of Fund Development for the National Alliance for the Mentally Ill in St. Tammany ("NAMI-St. Tammany"), a non-profit organization, which contracts with FPHSA to provide peer support services in mental health clinics and to maintain an online Resource Directory for the area. The question was asked if Ms. Falconer's service on both the FPHSA board and the NAMI-St. Tammany board presents a conflict of interest.

Law:
La. R.S. 42:1112B(3) prohibits a public servant from participating in a transaction involving the governmental entity in which, to his actual knowledge, any person of which he is an officer, director, trustee, partner or employee has a substantial economic interest.

La. R.S. 42:1120.4 allows an appointed member of a board or commission to recuse himself from participating or voting on any matter in which a potential violation of La. R.S. 42:1112.

Recommendations:
Adopt the proposed advisory opinion.
