Reconsideration of a waiver request submitted by Jewel Jaudon, a member of the Greenwood Board of Aldermen, Caddo Parish, regarding a $1,500 late fee assessed for filing a 2012 Tier 3 annual pfd 186 days late.
Facts:
At the October 2014 meeting, the Board suspended all but $500 based on future compliance with the Code of Ethics. Ms. Jaudon states that she cannot afford to pay the $500. Ms. Jaudon states that her company took away her overtime work, which accounted for an extra $1,200 month that she no longer brings home. Further, she states that her insurance costs increased in January 2015. Ms. Jaudon also states that she helps care for her daughter and grandson. She states that she is $600 short every month.


The previous information submitted shows her bank account and monthly premiums for insurance. It also shows fees for insufficient funds.


Previous Information:


Ms. Jaudon states that she timely faxed her pfd in early 2013 and again in May 2013. The IT Department conducted a fax search and only found a document faxed in 2012 and a document faxed on March 17, 2014. No faxes were found faxed in 2013.

Ms. Jaudon also states the imposition of the late fee will create a financial hardship. She states that she is a single parent who is supporting one son while he attends college and is helping another daughter who is attending nursing school and assisting her daughter with health insurance and medical bills involving her grandson. Her grandson underwent surgery in May 2014. Ms. Jaudon also suddenly lost her eldest son in March 2013. This late fee will compound the financial hardship she is already experiencing. Ms. Jaudon has submitted some documentation of her financial hardship.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
