Appearance in connection with a reconsideration of a waiver request submitted by Louis Lambert, Jr., a member of the University of Louisiana Systems-Board of Supervisors, regarding a $1,500 late fee assessed for filing his 2011 Tier 2.1 annual pfd 322 days late.
Facts:


Mr. Lambert was scheduled for an appearance at the October meeting; however, due to a calendering error, Mr. Lambert did not appear. The Board declined to waive his late fee. He is now requesting reconsideration.

As previously provided, Mr. Lambert, in August 2012, underwent pancreatic surgery in Wisconsin that removed 1/2 of his pancreas, removed his gall bladder and the upper portion of his small intestine. He stated that he had a very long recovery period of 8-12 months concluding in March 2013.

He also states that he had trouble getting his mail as he closed his law office for a short period and forwarded all mail to his home address. However, it appears that all mail was sent to his home address not his work address. Also, the notice of delinquency was sent after March 2013 and Mr. Lambert has recently qualified to run for the Ascension Parish School Board and was subsequently elected when both of his opponents withdrew.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
