Reconsideration of a waiver request submitted by Tonia Dunn, a former member of the East Baton Rouge Parish Housing Authority, regarding a $1,500 late fee assessed for filing her 2012 Tier 2.1 annual pfd 88 days late.
Facts:
At the October 2014 meeting, the Board suspended all but $500 based on future compliance with the Code of Ethics. Ms. Dunn is appreciative; however, she states that she still cannot afford to pay the $500 late fee. She states that as a paraprofessional with the East Baton Rouge Parish School Board, most of her paycheck goes to medical insurance and retirement. She also maintains a part-time job at Dillards, which pays for food, gas, phone, and other needs for her family. She states she has barely any funds to spare and it is her own fault for not furthering her education after high school.


Initial Information:


Ms. Dunn states that she did not recall receiving the notice of delinquency. When she was advised of the name on the green card, she stated that it was her daughter's name, who is a Senior at Southern University. She states her daughter does not recall signing for the letter. She states that she is a single mother with three children, 2 in college and 1 in high school. She has advised her children not to sign for her mail anymore. She states that she works two jobs and has resigned her position on the housing authority as of October 22, 2013. She has filed her final report.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
Recommendations:
Suspend all but $250 based on future compliance with the disclosure requirements under the Code of Ethics and offer a payment plan.
