Brandon Johnson, a newly elected member of the MCSB, is employed as a professional driver with Mayo Tours, a local privately owned transportation company that provides chartered commercial motor vehicle and motor coach services for hire. Prior to Mr. Johnson's election to the MCSB, Mayo Tours was hired by the MCSD, on a trip-by-trip basis, to provide chartered transportation services to student groups involved in academic activities or competitive athletic activities that required travel.
Mr. Johnson has no ownership interest in, nor does he hold an administrative office or supervisory responsibilities with, Mayo Tours. Additionally, he accepts trips that are assigned to him by Mayo Tours, as determined by Mayo Tours. Finally, Mr. Johnson's compensation from Mayo Tours consists of a set monetary sum for each mile driven and a daily per diem of $35 while on driving assignments.

Section 1111C(2)(d) prohibits a public servant or legal entity in which he exercises control or owns an interest in excess of 25% from receiving any thing of economic value for services performed for or compensated by any person that has or is seeking to obtain contractual or other business or financial relationships with the his agency.
