Waiver request submitted by Kent Schexnaydre, a member of the Ascension Parish Council, regarding a $2,500 late fee assessed for filing a R.S. 42:1114.3 disaster or emergency contract disclosure 115 days late.
Facts:
Kent Schexnaydre is a member of the Ascension Parish Council. He is also the owner of Schexnaydre Restoration and Construction, LLC. In an abundance of caution, Mr. Schexnaydre filed this R.S. 42:1114.3 disaster disclosure statement disclosing his receipt of funds through his company pursuant to a contract between his company and the Town of Grand Isle.
The contract provides for the construction of a new maintenance and storage facility. It came Mr. Schexnaydre's attention that the contract was being paid through a grant from FEMA. However, the contract was not entered into as a result of or related to a gubernatorially declared disaster or emergency.

Law:
La. R.S. 42:114.3 provides that each elected official, each appointed state official, and each immediate family member of an official subject to this Subsection or Subsection A of this Section who derives, either directly or through a legal entity in which such official or immediate family member owns ten percent or more, any thing of economic value through any contract which is related to a gubernatorially declared disaster or emergency and which the official or immediate family member knows or should reasonably should know is or may be funded or reimbursed in whole or in part with federal funds shall disclose the information required by this Section.
Recommendations:
Rescind the late fee.
