Advisory opinion request by Oscar Dantzler of Dantzler's Affordable Bail Bond regarding whether he may continue to work as a bail bondsman if he is hired as a Deputy Marshal for the 7th Ward District in Tangipahoa Parish (District).
Facts:
Mr. Dantzler is the owner of Dantzler's Affordable Bail Bond. He is registered to post bond in St. Helena, Tangipahoa, St. Tammany, East and West Baton Rouge, and West and East Feliciana Parishes. He is seeking employment as a deputy marshal for the District. The job duties of that position include providing courtroom security for criminal and civil court, serving criminal and civil papers such as evictions, seizures, writ of fieri facias, patrol, sequestration, warrants, summons, making arrests and letting them post bonds.
Law:
La. R.S. 42:1113A(1)(a) prohibits a public servant, member of his immediate family, or legal entity in which he has a controlling interest from entering into any contract, subcontract or other transaction under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 13:1881 provides that the marshal is the executive officer of the court; he shall execute the orders and mandates of the court and in the execution thereof, and in making arrests and preserving the peace, he has the same powers and authority of a sheriff. The marshal may appoint one or more deputy marshals having the same powers and authority as the marshal, but the marshal shall be responsible for their actions.

Recommendations:
Adopt the proposed advisory opinion.
