Advisory opinion request regarding whether the Board of Commissioners of the Greater Baton Rouge Airport District are required to file personal financial disclosure statements.
Facts:
The Greater Baton Rouge Airport District was created by Act 151 of the 1969 Regular Session of the Louisiana Legislature. The District is a subdivision of the State that is governed by the Airport Authority and the Board of Commissioners of the Greater Baton Rouge Airport District (Commission). The Airport Authority consists of the Mayor-President and the Metropolitan Council of the City of Baton. The Commission is made up of 13 members--9 appointed by the Metropolitan Council and 4 who are the State Representatives and Senators of the legislative districts in which airport resides. The legislative members may serve personally or select an individual to act as his/her designee. The creation of the District and Board of Commissioners is codified by the City of Baton Rouge in its Code of Ordinances.

The Commission is responsible for recommending to the Authority: the selection of airport sites and facilities; a proposed annual budget; contracts for lease; and other contracts for services at the Airport. The actions of the Commission are not final and merely advisory. All actions of the Commission must be ratified by the Metropolitan Council of the City of Baton Rouge. The Metro Council has the power make the actions of the Commission final and binding, as well as the right to suspend or revoke any action of the Commission.

Law:
Section 1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year.


Section 1124.2.1D(1)(a)(ii) states that a "board or commission" means each board, commission, and like entity created by the constitution, by law, by a political subdivision, except as provided in Subparagraph (b) of this Paragraph, or jointly by two or more political subdivisions acting as a governing authority of a political subdivision of the state or of a local government.

Recommendations:
Adopt draft of advisory opinion.
