Advisory opinion request regarding whether Brian Champagne, the Registrar of Voters for St. Charles Parish, can express his opinion for or against proposed legislation before a committee of the legislature or to a legislator individually.
Facts:
Brian Champagne is the Registrar of Voters for the Parish of St. Charles.
Comments:
Registrars of Voters are given their authority by La. R.S. 18:51, which provides that there shall be one registrar for each parish appointed by the parish governing authority. Registrars receive compensation from the State (through the Secretary of State) and the Parish and the compensation is fixed by statute according to the population of the Parish.

The Board previously stated that Registrars of Voters are not "state employees" as contemplated in La. R.S. 24:56F.

Law:
La. R.S. 24:56F provides that no state employee in his official capacity or on behalf of his employer shall lobby for or against any matter intended to have the effect of law pending before the legislature or any committee thereof. Nothing herein shall prohibit the dissemination of factual information relative to any such matter or the use of public meeting rooms or meeting facilities available to all citizens to lobby for or against any such matter.
Recommendations:
Adopt the proposed advisory opinion.
