Answer submitted by Robert Allen Whelan, a former board member of the St. Tammany Parish Recreation District #1 - Pelican Park, in lieu of filing a personal financial disclosure statement in response to a notice of delinquency.
Facts:
Robert Allen Whelan, a former board member of the St. Tammany Parish Recreation District #1 - Pelican Park (Pelican Park), received a notice of delinquency on February 2, 2015, requesting he file his 2013 Tier 2.1 annual personal financial disclosure statement (PFD). Mr. Whelan filed an answer on February 5, 2015, stating that he no longer serves as a board member; however, he failed to provide the date that his service terminated.

According to Kathy Foley, Director of Pelican Park, Mr. Whelan resigned in May 2014.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. However, if the holding of the office terminates in January, then he will not be required to file a financial statement the year following termination as long as he files a financial statement during the year in which the holding of the office terminates that includes the period he held the office that year.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Advise Mr. Whelan that he has 7 business days to file a 2013 Tier 2.1 PFD.
