W. Nelson Philpot, a former board member of the Homer Memorial Hospital Service District, received a notice of delinquency on February 10, 2015, requesting he file a hospital service district disclosure statement for 2015. James Colvin, Jr. filed an answer on behalf of Mr. Philpot on February 11, 2015. Mr. Colvin stated that the Town of Homer entered into an Intergovernmental Agreement (Agreement) transferring management of the Homer Memorial Hospital from the Town to the Claiborne Parish Police Jury (Police Jury) on September 10, 2014. Mr. Colvin included a copy of the Agreement. As a result of the Agreement, the Police Jury populated a parish-wide hospital service district board of commissioners, Claiborne Parish Hospital Service District #3 (District), to manage the hospital. Mr. Philpot is not a commissioner for the District. Therefore, Mr. Philpot is not required to an annual disclosure statement in accordance with La. R.S. 42:1119B(2)(b)(iii).

La. R.S. 42:1119B(2)(b)(iii) provides that no later than January thirtieth of each year, any chief executive and any member of a board of a hospital service district or hospital public trust authority whose immediate family member enters into an initial recruiting contract with or is employed by the hospital service district or hospital public trust authority pursuant to this Subparagraph shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement under this Item may be assessed a late fee of fifty dollars per day, not to exceed one thousand five hundred dollars, subject to the provisions of R.S. 42:1157.
