Advisory opinion request regarding whether Christopher Basile, a laborer for the St. Bernard Parish Department of Recreation, Culture, and Tourism (DRCT), may work as a contract employee with Greater New Orleans Sports Officials, if they secure a professional services agreement with St. Bernard Parish government.
Facts:
Mr. Basile is a laborer for DRCT. His duties include but are not limited to, maintaining baseball fields at a baseball complex by cutting the grass, marking the fields for play, and picking up trash around the complex. Greater New Orleans Sports Officials would provide contract workers to officiate all parish recreational sporting events. The services performed would be directly under the supervision of the DRCT. Mr. Basile would be hired by the company as an independent contractor to assist them with assigning the officials for the sporting events.
Law:
La. R.S. 42:1113A(1)(a) of the Code prohibits a public servant or immediate family member from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1111C(2)(d) provides that a public servant shall not receive anything of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public unless such services are neither performed for nor compensated by any person who has or is seeking to obtain a contractual or other business or financial relationships with the public servants agency.

Recommendations:
Adopt the proposed advisory opinion.
