RE:
Answer submitted by Brad A. Brechtel, a former member of the Children's Charter School Board in response to a notice of delinquency. Children's Charter School is located in East Baton Rouge Parish.
Facts:
Mr. Brechtel received a notice of delinquency requesting the he file his 2013 Tier 3 annual personal financial disclosure statement. Mr. Brechtel filed an answer January 27, 2015, stating that he did not serve on the Board in the 2013 calender year. Therefore, he was not required to file a disclosure statement for 2013.
Law:
La. R.S. 42:1124.3 requires each person holding a public office who represents a voting district having a population of fewer than five thousand and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950, except any person who is required to file a financial statement by R.S. 42:1124, 1124.2, or 1124.2.1, to file a financial statement by May 15th of each year during which the person holds such office and the year following the termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to timely file, omission of information or inclusion of inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the filer that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such a failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Advise Mr. Brechtel that he is not required to file a 2013 Tier 3 annual personal financial disclosure statement.
