Appearance in connection with a request that the Board reconsider waiving the $1,200 in campaign finance late fees assessed against Charles O'Brien, a candidate for School Board Member, District 8, East Baton Rouge Parish in the November 4, 2014 Election, whose EDE-P campaign finance disclosure report was filed 20 days late, and 10-G campaign finance report was filed 62 days late.
Facts:
In connection with his request that the Board waive the late fees assessed for the late filing of the reports, Charles O'Brien states that it was his understanding that if there were no changes to the reports or if $0 was all that would be reported, no subsequent filing was required. Mr. O'Brien stated that no changes occurred since submitting the filing the first form. Moreover, the electronic filing software was not user friendly and this was his first time using the electronic computer system.

The Board previously considered Mr. O'Brien's waiver request at the April 2015 meeting. Mr. O'Brien was unable to make an appearance because he was out of town.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Affirm the prior decision to decline to waive for the 10-G and EDE-P reports.
