Advisory opinion request by Dawn Brown regarding whether being employed by District 62 Gang 550 within the Department of Transportation and Development (DOTD) will pose a conflict with her outside employment as owner and operator of CDL Training & Consulting LLC (CDL Consulting).
Facts:
Ms. Brown may be rehired as a mobile equipment operator for District 62 Gang 550 (Gang) depending on the result of this request. The duties of this position include working with the grass or road crew by filling pot holes, picking up debris, trash and tires off roads and highways, and working as a flag person while certain road/grass work is being done.
Ms. Brown has been self-employed as owner and operator of CDL Consulting. She has previously conducted CDL (Commercial Drivers License) testing for the DOTD not including her Gang, Livingston Parish School Board, and Regina Coeli Child Development. The Department of Public Safety & Corrections sets the standards for a CDL and they audit and inspect her testing records and course.

Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant from receiving any thing of economic value for the provision of services to or for a person that has or seeks a business, contractual of financial relationship with the public servant's agency.

La. R.S. 42:1111A prohibits public servants from receiving anything of economic value, other than compensation and benefits from the governmental entity to which she is duly entitled, for the performance of the duties and responsibilities of her office or position.

Recommendations:
Adopt the proposed advisory opinion.
