RE:
Request that the Board reconsider waiving the $840 campaign finance late fee assessed against Clyde Hamner, a candidate for Terrebonne Parish School Board, District 6, in the November 4, 2014 Election, whose 30-P campaign finance disclosure report was filed 21 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Clyde Hamner states that he qualified for and joined the race late. He mistakenly thought that he did not have to report his own expenditures until after the election unless he had received contributions. He assumed that notices regarding deadlines would be sent.
The race cost him over $9,000 of his own money, and he only had one contribution of $250 and one in-kind donation of $750. He has no additional funds and it would be a personal hardship to come up with another $840 out of pocket.

Mr. Hamner asks for a reconsideration because he used the dates on his 30-P report that he ordered the items for his campaign. However, he did not make the expenditure to pay for these items until October 9, 2014, which falls within the reporting period for the 10-P report. He also states that the information submitted on both the 30-P and the 10-P are the same.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Suspend all but $100 based on future compliance. The fine is payable within 30 days or the suspended portion becomes due.
