Advisory opinion request regarding whether Lindora Baker, a Caddo Parish Commissioner, may accept employment with a medical clinic owned by Biomedical Research Foundation of Northwest Louisiana at a time when Biomedical Research Foundation of Northwest Louisiana has a financial relationship with Caddo Parish.
Facts:
Lindora Baker is a member of the Caddo Parish Commission. Presently, a millage exists for the benefit of the Biomedical Research Foundation of Northwest Louisiana (the "Foundation"), a nonprofit corporation, that is distributed through the Caddo Parish Finance Department. The Caddo Parish Commission voted in January 2015 to present the millage to the voters in May 2015 for renewal. In addition, the Caddo Parish Commission has agreed to fund the Foundation's Entrepreneurial Acceleration Program in the amount of $500,000/year for five years between 2014 through 2018.

The Foundation took over the LSU Health and Sciences Center, a public hospital, and it is now a wholly owned subsidiary of the Foundation under the name University Health Center. The University Health Center has two clinics it runs, one in Shreveport and one in Monroe. Ms. Baker would like to accept employment at the clinic located in Shreveport.

Law:
La. R.S. 42:1111C(2)(d) provides that no public servant and no legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, shall receive any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency.
Recommendations:
Adopt proposed advisory opinion.
