Appearance in connection with a waiver request submitted by Lyndon Blanchard, a former member of the Aquatic Chelonian Research and Promotion Board, regarding a $1,500 late fee assessed for filing his 2012 Tier 2.1 annual pfd 399 days late and a $1,500 late fee assessed for filing his 2013 Tier 2.1 annual pfd 66 days late.
Facts:
The waiver requests are 14 days late and 1 day late, respectively. However, Mr. Blanchard states that both his 22 year old daughter and 6 month old granddaughter were in a serious car accident on February 8, 2015 and remained hospitalized for 5 days. Mr. Blanchard states that his daughter is incapcitated as a result of the accident. He states that he and his wife have been totally consumed with their care. He states that both his daughter and granddaughter are in need of his and his wife's attention for the next two months.

Mr. Blanchard states that he was late with the deadlines because he never truly understood why he was getting these documents. He states that he does not understand technical terms or anything else to do with this type of board or any board.

Mr. Blanchard resigned from the board on June 3, 2013.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
