Appearance in connection with a request to reconsider the denial of a waiver request submitted by Jimmy Laurent, Sr., a member of the St. Tammany Parish 911 Commission, regarding a $1,500 late fee assessed for filing his 2012 Tier 2.1 annual pfd 103 days late.
Facts:
Mr. Laurent's reconsideration request states that he is unfamiliar with the filing requirements, believes the pfd was timely filed, but was asked to amend his pfd to disclose his wife's income, which he states he did when notified. Mr. Laurent is confusing his pfd reports. Mr. Laurent was asked to amend his 2011 pfd, which he amended late and was assessed a $1,500 late fee. Mr. Laurent never requested a waiver in connection with that late fee.

The late fee at issue herein, involves his failure to file his 2012 pfd.

Initial Information:


Attorney Ronald Guth requested the first waiver on Mr. Laurent's behalf stating that due to the current economic conditions in the home building business in east St. Tammany Parish and a particular family problem with one of his children, the imposition of the late fee would create a severe financial burden.

Mr. Laurent states he did not know what needed to be filed and that his is 59 years old and not very good with computers as he has never had to work on computers.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
Recommendations:
Affirm the Board's decision to decline to waive.
