Advisory opinion request regarding whether Mark Perry, an employee of the Department of Health and Hospitals' Medicaid Bayou Health Program, can be employed as the Provider Relations Manager with Aetna Better Health, Inc., following the termination of his public service.
Facts:
Mark Perry has been employed with the Department of Health and Hospitals (DHH) for more than nine years. He currently serves as the Bayou Health Subject Matter Expert for Provider Network Adequacy and Provider Services for the Medicaid Bayou Health Program. He was not directly involved in the development of the Bayou Health Request for Proposals, nor did he have a role in the evaluation and scoring of the proposals. However, he was involved to some degree with implementation after the contracts were awarded. In his current position, he is responsible for reviewing Aetna's policy documents, provider network adequacy data, and other provider related reports and materials to monitor Aetna's contract compliance.

Aetna is a managed care organization that contracted with DHH to provide services to eligible Louisiana Medicaid enrollees as one of the five Bayou Health Plans (Plans). As the Provider Relations Manager for Aetna, Mr. Perry's duties would include managing the activities of Aetna's Provider Relations Department; overseeing the maintenance of working relationships with Aetna's existing network, and assisting in the recruitment of new providers; developing processes to collect and maintain accurate and current provider databases; assisting in the development of policies and procedures; and developing and implementing training programs and educational materials for Aetna's providers and internal staff.

Law:
La. R.S. 42:1121B(1) prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, in which he participated at any time during his public employment and involving his former governmental entity, or from rendering any service that he had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of his former agency.
Recommendations:
Adopt the proposed advisory opinion.
