Consideration of an opinion concerning Jimbo Davlin failing to file reports in connection with the October 4, 2003 election.
Facts:
Mr. Davlin was an any other office candidate for Caddo Parish Commissioner in the October 4, 2003 election. Prior to June 25, 2007, "any other" office level candidates who received a contribution over $200, including their own funds, were required to file campaign finance reports. Effective June 25, 2007, "any other" office level candidates did not need to include the use of the candidate's personal funds when determining whether they went over the $200 threshold that triggered reporting. Under the current disclosure requirements effective June 25, 2007, Mr. Davlin would not have been required to file reports since he only spent $600 of his own money.



Mr. Davlin is asking for a suspension of the penalty or, in the alternative, reinstatement of the original decision to suspend $4,000 of the penalty, if he pays $1,000.

Comments:
Jimbo Davlin was a candidate in the October 4, 2003 election. Charges were issued concerning his failure to file campaign finance reports in connection with the election. The Board imposed a $1,000 late fee and an additional $4,000 civil penalty for failure to file a 10-G campaign finance disclosure report. Mr. Davlin has not paid the penalty.

Recommendations:
Reinstate the original decision to suspend $4,000 of the penalty, if Mr. Davlin pays $1,000.
