Request that the Board waive the $700 late fee assessed against Phyllis Sims for failure to timely file a Supplemental Lobbying Registration Report.
Facts:
Ms. Sims filed her Supplemental Registration report that was due by January 21, 2015, 14 days late on February 4, 2015. She was assessed a late fee of $700. Ms. Sims and her law partner, Chris Dicharry, share a legal assistant who always filed their annual registration timely and sometimes filed the monthly reports. Ms. Sims states that there was a change in personnel in May of last year and hired a new legal assistant, Marybeth West.

Ms. West completed Mr. Dicharry's 2015 registration timely, but did not complete the registration for Ms. Sims. It wasn't until Ms. West mentioned that she had paid Mr. Dicharry's registration with his American Express card and Ms. Sims inquired as to how her registration was paid that she realized her registration had not been completed.

Although she knows that she is ultimately responsible for making sure the annual registration and monthly reports are filed, her late filed registration was due to a misunderstanding in communication.
