RE:
Request that the Board waive the $100 late fee assessed against Charles McMains, Jr. for failure to timely file a Supplemental Lobbying Registration Report.
Facts:
Mr. McMains filed his Supplemental Registration report that was due January 10, 2015, two days late on January 12, 2015. He was assessed a late fee of $100. Mr. McMains states on January 12, 2015, his registration was filed. It included the clients for which he had contacts to represent in 2015 and excluded those for which they had no contracts in place for 2015. It is his understanding that La. R.S. 24:53E automatically terminates the registration of lobbyists on the 31st of December and provides that they have until January 31st to file a renewal registration for the current year. It does not provide for supplemental registrations for additions or terminations during the renewal process. Therefore, he questions why he was assessed a fine for the late filing of a termination, which terminated already as a matter of law on December 31st.

Law:
La R.S. 24:58D(1), 49:78D(1) state that any person required to register and who fails to timely register and any person who fails to timely file any report required by this Part shall be assessed, pursuant to R.S. 42:1157, a late fee of fifty dollars per day.
Recommendations:
Waive the fine.
