RE:
Advisory opinion request regarding whether Jacob Coco may be employed by the Paragon Casino Resort if he is elected to alderman for the Town of Simmesport.
Facts:
Jacob Coco is currently seeking employment with Paragon Casino and plans on running for alderman for Simmesport in the 2015 Fall election. He stated that Simmesport has no relations with Paragon Casino and his position would not be within its administration. Paragon Casino is owned by the Tunica-Biloxi Indian Tribe.
Law:
La. R.S. 27:96A(1) provides that no elected official as defined in R.S. 42:1 shall engage in any business activity with a licensee except as a patron, or as a performing professional musician.

25 U.S.C. 2701(5) provides that Indian tribes have the exclusive right to regulate gaming activity on Indian lands if the gaming activity is not specifically prohibited by Federal law and is conducted within a State which does not, as a matter of criminal law and public policy, prohibit such gaming activity.

Recommendations:
Adopt proposed advisory opinion.
