Advisory opinion request regarding whether Rebecca Reid may continue to be employed as a math teacher at Hammond High Magnet School while Therese Domiano, her mother, serves as a member of the Tangipahoa Parish School Board.
Facts:
Therese Domiano was sworn in as Tangipahoa Parish School Board member on January 6, 2015. Rebecca Reid, her daughter, does not possess a certification to teach but took a temporary position to teach at Hammond High Magnet in October of 2014. She began the process to obtain a teacher certification after accepting the position.
Law:
La. R.S. 42:1119A of the Code of Governmental Ethics states no member of the immediate family of an agency head shall be employed in his agency.

La. R.S. 42:1119B(2)(a)(i) states that any local school board may employ any member of the immediate family member of any board member or of the superintendent as a classroom teacher provided that such family member is certified to teach.

La. R.S. 42:1119C(2) states that the provisions of this Section shall not prohibit the continued employment of any public employee nor shall nor shall it be construed to hinder, alter, or in any way affect normal promotional advancements for such public employee where a member of public employees' immediate family becomes the agency head of such public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family member becoming the agency head.

Recommendations:
Decline to render due to past conduct.
