RE:
Request that the Board waive the $1500 late fee assessed against Mackenzie Ledet for failure to timely file a Supplemental Registration Report.
Facts:
On March 27, 2015, Mrs. Ledet filed her Supplemental Registration report that was due by November 19, 2014, 44 days late on January 2, 2015. She was assessed a late fee of $1500. Mrs. Ledet spoke with our lobbying staff regarding her representation of Deep South Studios. Mrs. Ledet states that at the time of the purported registration, she was employed by Baker, Donelson, Bearman, Caldwell & Berkowitz, PC and represented various clients before the legislature as a registered lobbyist in this state.

As of March 27, 2015, she was no longer employed by Baker Donelson. Effective March 30, 2015, she was the Director of Governmental Relations with Stonehenge Capital Company, LLC. She timely amended her registration to reflect the changes in her employment and representation. While employed by Baker Donelson, her registration with the Board of Ethics was performed and managed by staff. Prior to our March 25, 2015 letter to her and the identical letter to John Davis, they had not experienced any problems with their registration or filings. With respect to the registration of Deep South Studios, their staff at Baker Donelson erroneously registered November 14, 2014, as the beginning of their representation on behalf of Deep South Studios, which was an incorrect date. Although the staff erroneously completed her registration, Mrs. Ledet recognizes that she is fully responsible for managing and accurately reporting the necessary information. She takes full responsibility for this error and she now has a full and complete understanding of this requirement. This error and corrective measures were shared with the Baker Donelson staff.

La R.S. 24:58D(1), 49:78D(1) state that any person required to register and who fails to timely register and any person who fails to timely file any report required by this Part shall be assessed, pursuant to R.S. 42:1157, a late fee of fifty dollars per day.
Recommendations:
Suspend all based on future compliance.
