Request that the Board waive the $6,060 in campaign finance late fee assessed against Daniel Wayne Bush, a candidate for District Judge, 30th Judicial District, Vernon Parish in the November 4, 2014 Election, whose 2013 Annual campaign finance disclosure report was 182 days late, 30-P campaign finance disclosure report was filed 1 day late, 10-P campaign finance disclosure report was filed 140 days late, and 10-G campaign finance disclosure report was filed 110 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the reports, Daniel Wayne Bush states that his life partner of more than 13 years, who was in charge of filing his campaign finance reports, was diagnosed with lung cancer on July 2013 and subsequently died on October 28, 2014. In addition to multiple hospital stays in ICU, he brought his partner to multiple trips to the doctors and to receive several rounds of radiation and chemotherapy. He had no time to campaign and took off approximately six months from work to be with him and after he passed. Moreover, the reason for seeking this waiver request is because it would cause from a financial hardship, as he depleted his savings to care for his partner and fulfill his wishes.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Rule 1205C allows a late fee to be reduced to the amount of activity or 10 times the per day penalty, whichever is greater, if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed.


Recommendations:
Decline to waive the late fees for the 2013 Annual and 30-P reports.

Waive the late fee for the 10-P report

Reduce the late fee for the 10-G report to $600 pursuant to Rule 1205C.
