RE:
Request that the Board waive the $2,120 in campaign finance late fees assessed against Leon Bradberry, Sr., a candidate for Constable, 4th Justice Court, Jefferson Parish in the November 4, 2014 Election, whose 30-P campaign finance disclosure report was filed 59 days late, 10-G campaign finance disclosure report was filed 8 days late, 10-P campaign finance disclosure report was filed 38 days late, and EDE-P campaign finance disclosure report was filed 27 days late.
Facts:
In connection with his request that the Board waive the late fees assessed for the late filing of the reports, Leon Bradberry, Sr. states that he was not aware of the requirements because he always was unopposed during his election bids and never dealt with campaign donations and expenditures. Mr. Bradberry further states that he has taken all the necessary steps to ensure this does not recur and asks that the Board please forgive his first infraction, or in the alternative, reduce the amount. The amount of the fines exceeds the amount of the contributions received during his campaign.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Decline to waive for the 30-P and 10-P reports. Suspend all based on future compliance for the EDE-P report. Suspend all but $100 for the 10-G report which is payable within 30 days or the suspended portion becomes due.
