Advisory opinion request as to whether a business owned or partially owned by a board member of the Lafayette City-Parish Civil Service Board may do business with employees of the Lafayette City-Parish Government.
Facts:
The Lafayette City-Parish Civil Service Board ("Civil Service Board") was created by the Lafayette City-Parish Government ("LCG") charter and is composed of five unpaid appointed board members who meet quarterly to: (1) adopt rules governing civil service employment, classification and pay, hearings and appeals; (2) act on recommendations made by the Civil Service Department's staff to make classification and pay changes; and (3) hear appeals of disciplinary action by classified employees. The Civil Service Board appoints and is served by the Director of Civil Service, who supervises the staff of the Civil Service Department.
An advisory opinion is being sought as to whether a business owned or partially owned by a member of the Civil Service Board may do business with employees of LCG because there are often vacancies on the Civil Service Board and potential appointees to the Civil Service Board are frequently small business owners.

Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant and any legal entity in which the public servant exercises control or owns an interest in excess of 25% from providing compensated services to a person (1) who has or is seeking to have a contractual, business, or financial relationship with the public servant's agency; (2) who conducts operations or activities which are regulated by the public servant's agency; or (3) who has substantial economic interests which may be substantially affected by the performance or nonperformance of the public servant's official duty.
Recommendations:
Adopt the proposed advisory opinion.
