Director Jackson requested an advisory opinion regarding whether the Code of Governmental Ethics would prohibit the City of Shreveport from re-hiring retired former employees within two years of their termination. She stated that the issue has come up on several occasions and the city would like to know if they may re-hire retirees on a part-time basis to perform the same duties as they did before they retired.

La. R.S. 42:1121B prohibits a public servant, for a period of two years following the termination of his public employment, from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
