Advisory opinion request regarding whether David Pourciau, as the former Chief Appraiser in the Appraisal Office within the Department of Transportation and Development, can be employed by PEC Engineering as the Review Appraiser on a project for East Baton Rouge Parish.
Facts:
David Pourciau retired from his position as the Chief Appraiser in the Appraisal Office within the Department of Transportation and Development (DOTD) on March 26, 2015. As the Chief Appraiser, he was responsible for supervising lower-level appraisers and consultants, monitoring all subject property inspections for the appraisal assignment, and signing off on all appraisal reports of lower-level appraisers for all DOTD projects.

East Baton Rouge Parish has contracted with PEC Engineering (PEC) to design the I-10 Interchange at Pecue Lane and acquire the property for the project. As the Review Appraiser hired by PEC, Mr. Pourciau would be responsible for reviewing all of the appraisals used to value the property to be acquired for the project. Since the Parish will wholly manage the project, DOTD's Appraisal Office will not review the appraisals. However, the State will reimburse the Parish for a portion of the costs. Therefore, DOTD, through its Baton Rouge District Real Estate Office, will review and approve the files for the reimbursement.

Law:
La. R.S. 42:1121A(1) prohibits a former agency head, for a period of two years following the termination of his public service as the head of such agency, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or rendering any service on a contractual basis to or for such agency.
Recommendations:
Adopt the proposed advisory opinion.
