Advisory opinion request regarding the propriety of a policy of the Orleans Parish Communication District that allows an employee to transfer accrued leave to another employee.
Facts:
The OPCD has a written policy allowing for an employee to transfer accrued leave to another employee who has used all of his/her accrued leave. That policy is being reviewed and/or revised in order to comply with federal, state and municipal regulations.
Comments:
The Orleans Parish Communication District (OPCD) is a political subdivision that was legislatively created pursuant to La. R.S. 33:9101, et seq. to provide 911 emergency services for the Parish of Orleans.

The New Orleans Civil Service Commission (Commission), created by La. Const. Art. X, 4(B), is vested with broad and general rulemaking and subpoena powers for the administration and regulation of the classified service for the municipality. Pursuant to La. Const. Art. X, 10, the Commission has the power to adopt rules for regulating employment, promotion, demotion, suspension, reduction in pay, removal, certification, qualifications, political activities, employment conditions, compensation and disbursements to employees, and other personnel matters and transactions; to adopt a uniform pay and classification plan; to require an appointing authority to institute an employee training and safety program; and generally to accomplish the objectives and purposes of the merit system of civil service as herein established.

Recommendations:
Decline to render an opinion and advise the OPCD to contact the New Orleans Civil Service Commission.
