Chauna Banks, a member of the East Baton Rouge Parish Metro Council, received two notices of delinquency (NOD) on April 22, 2015. The first NOD requested that she amend her 2012 Tier 2 Annual Personal Financial Disclosure Statement (PFD) to disclose employment information for her spouse on Schedule A. The second NOD requested that she amend her 2013 Tier 2 PFD to disclose employment information for herself and her spouse, because she did not complete Schedule A. Ms. Banks filed an answer on April 24, 2015, stating that she and her former spouse lived separate and apart from June 9, 2011, until their divorce was finalized on December 17, 2013. She provided a copy of the Judgment of Divorce and explained that she has no way to contact him to obtain the information.

La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of five thousand or more persons to file a financial statement by May 15th of each year during which the person holds such office and the year following the termination of the holding of such office.
La. R.S. 42:1124.4 provides that upon discovery of the failure to timely file, omission of information or inclusion of inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the filer that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such a failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
