RE:
Request that the Board waive the $400 campaign finance late fee assessed against Benny Druilhet, a candidate for Mayor, Town of Baldwin, St. Mary Parish in the November 4, 2014 Election, whose EDE-P campaign finance disclosure report was filed 12 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Benny Druilhet states that he filed his final report prior to filing his EDE-P report because he had no election day expenditures and assumed he could file the final report as a substitute of his EDE-P report.
Additionally, his oversight was attributed to the fact that his oldest brother passed away on November 10, 2014, requiring him to be preoccupied with assisting his brother's widow who also suffered a debilitating stroke, making funeral arrangements, and preparing to officiate the funeral and give the eulogy.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Rescind the late fee based on Rule 1205B.
