Advisory opinion request regarding the propriety of Dr. Sue Austin, an employee of the Department of Health and Hospitals, performing services on a contractual basis for the Department of Public Safety and Corrections after hours or while on annual leave.
Facts:
Dr. Sue Austin is a psychologist employed with the Office of Behavioral Health, Department of Health and Hospitals (DHH). She has been offered a contract to work 16 hours per week for the Department of Public Safety and Corrections (DOC) at Elayn Hunt Correctional Center. Dr. Austin would work three days a week for DHH and use two days of annual leave each week to perform her duties pursuant to the contract with DOC.
Comments:
Pursuant to La. R.S. 36:4, both DHH and DOC are departments within the executive branch of state government.
Law:
La. R.S. 42:1111A prohibits a public servant from receiving anything of economic value, other than compensation and benefits from the governmental entity to which she is duly entitled, for the performance of the duties and responsibilities of her office or position.

La. R.S. 42:1113A prohibits a public servant, or legal entity in which she has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of her agency.

Recommendations:
Adopt the proposed advisory opinion.
