Waiver request submitted by Henry Maitre, III, Constable for St. Bernard Parish, Ward E, regarding a $2,500 late fee assessed for filing his 2013 Tier 2 annual pfd 41 days late.
Facts:
Mr. Maitre appeared at a prior meeting and the Board deferred this matter to allow Mr. Maitre time to submit information showing that the population of Ward E is less than 5,000. Mr. Maitre states that he has been to all parish office in St. Bernard trying to obtain this information and he states that no one has the population of Ward E. He has only been able to find the number of register voters which is 2,208. He states that St. Bernard Parish has a population of 45,000 versus 70,000 prior to Katrina.

Mr. Maitre also states that he was injured in an on-job accident two years ago which has prohibited him from maintaining full-time employment since. He states that after everything is taken out of his check, he has $100 left over from his constable's pay. He states he does receive some additional money from evictions; however, that money is sporadic as he may do one eviction a week, several a week, or none.


Prior Information:


Mr. Maitre states he received the notice of delinquency in September 2014 and mailed in the form due to a fine in the past. Staff is not aware of a second letter being sent and received on September 16, 2014.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
