RE:
Reconsideration of a waiver request submitted by Keith Thompson, a member of the Louisiana Insurance Guaranty Association, that the Boad previously declined to waive regarding a $1,500 late assessed for filing his 2011 Tier 2.1 annual pfd 321 days late.
Facts:
Mr. Thompson states that he does not recall receiving a request to file prior to its initial due date. The Board does not sent out reminders nor is it required by law. Mr. Thompson stated that he does not recall receiving the notice of delinquency. It was signed for by his wife. He states the failing to file was an oversight. The late filing was not intentional and he appeals to the Board to be fair and reasonable and waive the late fees.

Mr. Thompson states that this is his only late filing. He states that his information has not changed and he has no conflicts of interest which would affect his impartial performance on the board. He has no explanation only that he must have assumed the pfd was already filed. Mr. Thompson requests this waiver based on the lack of harm and deceit related to this matter.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
Recommendations:
Affirm the Board's prior decision to decline to waive.
