Advisory opinion request regarding whether William Aaron, Jr., as a member of the Board of Directors of the Laureate Academy Charter School, may represent the Jefferson Parish School Board as a compensated special counsel in matters unrelated to the Laureate Academy Charter School.
Facts:
William Aaron, Jr. is a member of the Board of Directors of the Laureate Academy Charter School (Academy). The Academy, a Louisiana non-profit corporation, is a charter school authorized by the Jefferson Parish School Board (School Board). Members of the Board of Directors of the Academy serve without compensation and are not appointed by the School Board. However, as the chartering entity, the School Board is responsible for overseeing, monitoring and evaluating the Academy for compliance with academic, financial, legal, and contractual mandates.
The School Board is also responsible for analyzing and/or submitting certain student and financial data to the State of Louisiana on behalf of the Academy. Finally, the Academy submits its annual budget to the School Board and receives its funding through the School Board.

Comments:
In Docket No. 2013-842, the Board advised that employees of the Orleans Parish School Board could serve as members of the board of directors for charter schools authorized by the Orleans Parish School Board as long as they did not represent the charter school in matters before the Orleans Parish School Board. In that matter, the Orleans Parish School Board was responsible for overseeing, monitoring and evaluating the charter schools for compliance with academic, financial, legal, and contractual mandates. The Orleans Parish School Board was also responsible for analyzing and/or submitting certain student and financial data to the State of Louisiana on behalf of the charter schools. Finally, each charter school submitted its annual budget to the Orleans Parish School Board and received its funding through the Orleans Parish School Board.
Law:
La. R.S. 42:1113A prohibits a public servant, or legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency.

La. R.S. 42:1113B prohibits an appointed member of any board or commission, member of his immediate family, or legal entity in which he has a substantial economic interest from bidding on or entering into or being in any way interested in any contract, subcontract, or other transaction which is under the supervision or jurisdiction of his agency.

Recommendations:
Adopt the proposed advisory opinion.
