Waiver request submitted by Jimmie C. Ballard, Vinton Harbor and Terminal Board, regarding a $1,050 late fee assessed for filing his 2013 Tier 2.1 Annual PFD 21 days late.
Facts:
Sarah Ballard (on behalf of Jimmie Ballard) states that Mr. Ballard lost his wife unexpectly in January 2014. Two days after her death, his step-son informed him he needed to vacate the home he had shared with his wife for the last 40 yrs and started eviction proceedings. An eviction notice was placed on the premises a few days later, the day of the funeral. Mr. Ballard's son took him home with him to New Caney, Texas. Mr. Ballard did not return to Louisiana until May 2014. Ms. Ballard further explained that when he lost his home, all of his belongings were put into storage and as a result some of the mail was lost. She stated that once Mr. Ballard returned home, he was still sending mail to her in Texas for help. He was also under the care of several doctors as his own health was declining and he was suffering from depression. Mr. Ballard is in his late seventies and truly thought he had timely filed the pfd.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics disclosure requirements.
