Advisory opinion request by Debra Jackson, Tax Administrator for the Jackson Parish Sales Tax Commission, regarding whether Wayne Alford and Dennis Clary may legally serve as appointees to the Jackson Parish Sales Tax Commission while they receive income from the sales tax checks issued to them or their spouses by the Jackson Parish School Board.
Facts:
Wayne Alford and Dennis Clary currently serve on the Jackson Parish Sales Tax Commission and do not receive compensation or a per diem for their service on said commission. They or their spouse receive quarterly bonus checks from the Jackson Parish School Board from revenue directly related to and sent to the School Board from the Jackson Parish Sales Tax Commission.
Law:
La. R.S. 42:1112A states that no public servant, except as provided in R.S. 42:1120, shall participate in a transaction in which he has a personal substantial economic interest of which he may be reasonably expected to know involving the governmental entity.
La. R.S. 42:1112B states that no public servant, except as provided in R.S. 42:1120, shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest
Recommendations:
Adopt proposed draft declining to render an opinion due to past conduct.
