RE:
Request that the Board waive the $100 campaign finance late fee assessed against Michael Betts, a candidate for District Judge/21st Judicial District, Livingston Parish in the November 4, 2014 Election, whose EDE-G campaign finance disclosure report was filed one (1) day late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Michael Betts states that upon receiving a notice of a new program for LEADERS, he and his committee members were advised by the Ethics Administration that the old program would suffice. However, that turned to be difficult and caused problems, such as information appearing on the screen would differ from the actual saved report and expenditures on the report would mysteriously delete or otherwise fail to transmit.

In addition to it appearing as though amendments are causing old information to be lost, the windstorm that swept through Denham Springs/Baton Rouge ("three weeks ago" on the letter) blew out all of the computers on which the information was input into. The outside IT person is attempting to vet the information retrieved with another company's assistance.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all based on future compliance.
